Know these upfront. They affect what you can build and what permits you need before you sign with anyone.

Basement vs Cellar

NYC distinguishes between them. A basement has at least half its height above curb level. A cellar has more than half below. Only basements can be used as habitable space.

Ceiling Height (7 ft Min)

NYC requires minimum 7-foot ceilings in habitable basements, with 6-foot 8-inch headroom under beams. Shorter? You may need to lower the floor.

Egress Required

Habitable basements need at least one window large enough to climb out of in case of fire. Window wells, escape ladders, or proper basement entries can all qualify if sized to code.

ALT-2 Alteration Permit

Framing new walls, hanging drywall, and finishing the basement as living space triggers ALT-2 permits filed by your architect through a PW1 application.

LMP & LME Filings

A basement bathroom requires Licensed Master Plumber filing. New electrical circuits require Licensed Master Electrician filing of ELEC1. Both are separate from the main permit.

Certificate of Occupancy

Converting basement to in-law suite or apartment? You may need to update the C of O. Longer process — architect plans, full DOB review, final inspections.
